Where the European Union General Data Protection Regulation (GDPR) applies to the processing of personal data, such processing is carried out, in particular, on the legal bases provided for in Article 6 GDPR.
We also comply with the applicable provisions of Ukrainian data protection law.
3. Accessing Our Website and Server Log Files
When you access our website, the web server may automatically process certain technical information. This may include, in particular:

7. AI-powered Concierge (LERNER’S Concierge)
7.1. Purpose and Functionality
Our website provides an AI-powered digital assistant called LERNER’S Concierge.
The Concierge answers questions about our company, our services and the content of our website. Use of the service is voluntary and generally does not require registration.
We use the OpenAI Application Programming Interface (API) to generate responses.
7.2. Processing of Personal Data
When you use the Concierge, the following data may be processed:
Messages and questions submitted by you.
Personal information that you voluntarily provide in your messages.
Conversation history required to answer your questions.
Technical connection data necessary for providing and securing the service.
A technical visitor identifier used to limit requests and prevent misuse.
Usage information for statistical analysis of the service.
This processing is carried out to provide the digital assistant, respond to your enquiries, maintain technical security and improve our customer service.
Where the General Data Protection Regulation (GDPR) applies, the processing of general enquiries is based on our legitimate interests pursuant to Article 6(1)(f) GDPR.
For enquiries relating to an existing or potential contractual relationship, Article 6(1)(b) GDPR may serve as the legal basis.
7.3. Use of OpenAI and International Data Transfers
We use the OpenAI API to generate AI-powered responses.
The service provider is OpenAI OpCo, LLC, USA.
Your messages and the information necessary to generate a meaningful response are transmitted to OpenAI for processing.
Personal data may therefore be processed outside Ukraine and the European Economic Area, particularly in the United States.
International data transfers are subject to applicable legal requirements and contractual data protection safeguards. Where required, these include the European Commission’s Standard Contractual Clauses.
According to OpenAI, content submitted through its API is not used by default to train or improve AI models unless explicit permission has been granted.

7.4. Data Storage and Deletion
The Concierge processes conversation history during an active conversation. The WordPress plugin is not designed to permanently store complete chat transcripts.
The following data may additionally be stored for technical operation and protection against misuse:
Conversation history:
Temporarily processed in the browser while using the Concierge.
Visitor identifier:
Stored in the browser’s local storage without a fixed automatic expiry date. It can be removed by clearing the relevant browser data.
Technical abuse prevention:
Short-term storage of request-limiting information for approximately one minute.
Request limits:
Pseudonymised visitor identifiers and request counters are retained for up to 30 days.
Usage statistics:
Where enabled, aggregated daily statistical data is retained for up to 31 days and technical visitor-counting identifiers for up to two days.
Data processing by OpenAI:
OpenAI may retain API data for up to 30 days by default for abuse monitoring and security purposes.
Additional retention periods may apply depending on the API functionality and configuration used.
In particular, when the Responses API is used with the relevant storage settings enabled, response data may be retained as application state for at least 30 days.
Longer retention periods required by law or necessary for security purposes remain unaffected.
7.5. Voice Functionality
The Concierge may offer voice input.
When you activate voice input, your browser’s speech recognition functionality is used.
Depending on your browser and its settings, audio recordings may be transmitted to the relevant speech recognition provider for processing.
Such processing is additionally subject to that provider’s privacy policy.
The recognised text is subsequently processed by the Concierge in the same manner as a regular text message.
Voice input is optional. You may use the Concierge exclusively through text input.
7.6. Automated Responses and Usage Information
Concierge responses are generated automatically using artificial intelligence.
Although we aim to provide reliable and up-to-date information, AI-generated responses may be incomplete or inaccurate.
Responses do not constitute binding commercial, legal or other individual commitments.
Please do not submit passwords, payment information, health data or other particularly sensitive or confidential information through the Concierge.

8. Recipients and Data Processors
We may use external service providers for the provision, operation and maintenance of our website, including hosting providers, IT service providers and other technical service providers.
Where these service providers process personal data on our behalf, such processing is carried out on the basis of appropriate contractual arrangements and only to the extent necessary.
9. International Data Transfers
In connection with the use of our website or external service providers, personal data may be processed outside the country in which you are located.
Where the GDPR applies and personal data is transferred to a country outside the European Economic Area, we ensure, where required, that the applicable legal requirements for such international data transfers are met.
10. Data Retention
Personal data is retained only for as long as necessary for the respective purpose of processing or as required by applicable statutory retention obligations.
Once the purpose of processing no longer applies and there is no legal obligation to retain the data, the relevant personal data will be deleted or anonymised.
